2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 19.07.2024 passed in Cr. Misc. No. 44512 of 2024 .

3. The petitioner seeks regular bail in a case registered for the offence under Sections 302, 201, 120B/34 of the Indian Penal Code.

4. The following order was passed on 19.07.2024 in Cr. Misc. No. 44512 of 2024:- Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Ram Nagar P.S. Case No. 245 of 2023 registered for the offence under Sections 302, 201, 120B/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are said to have been seen with the deceased, whose dead body has been recovered.

4. Learned counsel for the petitioner submits that the petitioner was not seen with the deceased but it is another Vikash Kumar who was seen with the deceased.

5. During investigation, it has come that the petitioner is the Vikash Kumar, who was seen with the deceased.

6. The petitioner is in jail 2.8.2023 and the prayerfor bail of the similarly situated co-accused Samir Khan has been rejected twice by this Court.

7. Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this application is dismissed.

9. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest.

5. The learned counsel for the informant has submitted that out of eight witnesses, seven witnesses have been examined.

6. In these circumstances, this application for regular bail is hereby dismissed.
