JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 06-02-2019 The appellant seeks pre-arrest bail in connection with Marhaura P.S. Case No. 118 of 2015, registered for offences punishable under Sections 147, 341, 323, 324, 379, 504 of the Indian Penal Code and Section 3(i)(x) of SC/ST Act. Allegation against the appellant and other accused persons is of misbehaving and abusing a Barat party by taking caste name and on protest, the appellant assaulted the informant on head by bamboo causing injury.

Submission of learned counsel for the appellant is he has falsely been implicated in this case and no specific allegation has been attributed against him.

Having heard both sides, considering the facts and

Patna High Court CR. APP (SJ) No.4845 of 2018 dt.06-02-2019 2/2 circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the appellant, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this appeal is dismissed.
