Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 120B/409/420/ 467 /468 / 471/34 of the Indian Penal Code and Section 13(1)(d) of Prevention of Corruption Act, 1988.

Earlier prayer for bail to the petitioner was refused on 10.05.2018 in Cr. Misc. No.13449 of 2018. The petitioner is in custody since 12.08.2017.

Patna High Court CR. MISC. No.22141 of 2020(2) dt.02-11-2020 2/3 Submission is that co-accused Pankaj Kumar Jha challenged the order of refusal of bail by this Court before the Hon'ble Supreme Court in Cr. Appeal No.484 of 2020 arising out of SLP (Criminal) No.1530 of 2020 and by order dated 17.07.2020 Mr. Pankaj Jha was allowed bail considering the submission of learned counsel for the parties that the investigation of the case was already complete and further custody of the accused-appellant was not necessary. Since the case of the petitioner stands on similar footing as regards reason for grant of bail to co-accused Pankaj Kumar Jha by Honb'le Supreme Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with R.C. Case No.13/A/17 of 2017, arising out of Bhagalpur Kotwali (Tilkamanjhi) P.S. Case No.500 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to

(c) The petitioner shall not leave the country without permission of the trial Court.
