JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 Earlier petitioner was granted provisional anticipatory bail till submission of charge-sheet vide order dated 17.5.2018 passed in Cr.Misc.No. 28224 of 2018 with an observation that if charge-sheet has been submitted against the petitioner, he will surrender and pray for regular bail. Submission of learned counsel for the petitioner is without consider the materials on record and without verifying the signature of the petitioner charge-sheet has been submitted against the petitioner and the petitioner has come for modification of the order dated 17.5.2018.

In the facts and circumstances and in view of

Patna High Court CR. MISC. No.24340 of 2019(2) dt.17-04-2019 2/2 observation made earlier, I am not inclined to interfere with the earlier order dated 17.5.2018.

Petitioner to surrender and pray for regular bail, which shall be considered on the basis of the materials available on the record as well as submission of learned counsel for the petitioner.

With the above observation, this application is dismissed.
