The petitioner is accused in connection with Gadhpura P.S. Case No. 05 of 2019 registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-B)/a/35 of the Arms Act and Sections 30(a) and 32 of the Bihar Excise Act.

The accusation is of recovery of three live cartridges of 7.65 bore, two live cartridges of .315 bore and 375 ml Indian made foreign liquor of two bottles and two glasses from the dickey of the car, in which, six persons including the petitioner were found sitting.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.23346 of 2019(2) dt.12-04-2019 2/2 petitioner has no criminal antecedent and is in custody since 14.01.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-Cum-Special Judge, Excise Act, Begusarai, in connection with Gadhpura P.S. Case No. 05 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
