1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of regular bail in connection with Nauhatta P.S. Case no.122 of 2024 registered under sections 302, 341, 323, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, the informant states

Patna High Court CR. MISC. No.23887 of 2026(2) dt.16-04-2026 2/3 that the nine named accused persons including the two petitioners herein came and called the informant's younger brother outside. It is further stated that on the orders of Vikash Yadav, Deepak Yadav fired at the younger brother of the informant with a pistol causing firearm injury in his chest as a result of which he died.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. The allegations are general and omnibus against them. The specific allegation of firing is on co-accused Deepak Yadav and not the petitioners herein. The petitioners are in custody since 25.12.2025 and Rajesh Yadav has no criminal antecedent. Both of them undertake to cooperate in the investigation/trial. A number of other co-accused have been enlarged on bail.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR according to which the specific allegation of firing is solely on Deepak Yadav and not the petitioners herein together with the petitioners having remained in custody since 25.12.2025 and chargesheet having been submitted in the case, the Court directs both the

Case no.122 of 2024 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saharsa.
