Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
As per the prosecution case, all the FIR named accused persons, including this petitioner, abused and assaulted the informant with fist and kicks and it was co-accused, Yogendra Yadav who assaulted the informant and her child, who was in her lap, and the child sustained injuries and died. Learned counsel appearing for the petitioner submits that from bare perusal of the FIR it would appear that coaccused, Yogendra Yadav, caused the death of child of informant. There is general and omnibus allegation against this petitioner. It is further submitted that informant's son died due
Patna High Court CR. MISC. No.34060 of 2021(3) dt.21-07-2022 2/2 to diseases and not by the injuries caused by the petitioner and other accused persons. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh PS case No. 285/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
