The petitioner seeks bail in a case registered for the offence punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case as lodged by the informant is that when he was sitting at his shop some miscreants came in front of his shop and fired upon him with intention to kill him but which hit on the glass of his shop and it passed by the side of stomach of one of the customer of his shop namely Chandra Sarkar. The miscreants made 5-6 rounds firing. Learned counsel for the petitioner submits that the petitioner is innocent, not involved in the alleged occurrence,
Patna High Court CR. MISC. No.26399 of 2020(3) dt.02-12-2020 2/2 not named in the FIR and has been falsely implicated in this case. He submits that there is no recovery and no TIP has been done as yet. He submits that charge sheet has been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner. He further is languishing in judicial custody since 09.12.2019.
In the facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi Police Station Case No. 319 of 2019.
