Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Complaint Case No. 919 of 2019 registered for offence punishable under sections 323, 379, 420/34 of the Indian Penal Code.

As per allegation, co-accused Asif Ali executed a sale deed in favour of the complainant in respect of the land, which is Gairmajarua Aam.

No.32678 of 2021(2) dt.31-03-2022 2/2 The learned counsel for the petitioners has submitted that the petitioners have no concern with the alleged transaction, as neither they are executant of the sale deed nor they are witnesses of that sale deed. They have falsely been implicated in this case merely because they are wife and cousin brother of Rohit Kumar, attesting witness of that sale deed. Considering the above mentioned facts and circumstances, let the petitioners above named, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patna City, Patna in connection with Complaint Case No. 919 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
