The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 167 of 2020, dated 11.02.2020, instituted for the offences under Sections 341, 323, 354, 354(A) and 504/34 of the Indian Penal Code and Section 8/18 of the Protection of Children from Sexual Offences Act,

The allegation in the F.I.R. is that the daughter of the informant was attempted to be molested but with the timely arrival of local people, she could be saved. The name of the petitioner was told to the informant by the local Guard. Two other persons also have been named by the aforesaid Guard.

It has been submitted on behalf of the petitioner that the accusation against him is absolutely false. In fact, he, on the date of occurrence, was attending to his uncle who was hospitalized in Royal Emergency & Trauma Hospital Pvt. Ltd., situated at New Bypass Road on the outskirts of Patna.

The petitioner is stated to be in custody since 04.06.2020 and does not have criminal antecedents. Considering the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO Act),
