====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.
The petitioner seeks bail in connection with Pipra P. S. Case No.217 of 2018, instituted for the offences under Sections 392 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 10.12.2020 and charge-sheet has been submitted in this case.
The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that he works as a computer operator in Aman Hospital, Supaul and on 12.09.2018 at about 7.00 P.M. when he reached near East of the Papra Plant when

No.34379 of 2021(2) dt.01-12-2021 2/3 two persons riding on a white colour Apache motorcycle came and intercepted and asked whether the informant does business of cannabis (ganja). Thereafter one of the accused took out the mobile of the informant from his pocket and also taken his purse in which A.T.M. card and Aadhar card were kept. Thereafter miscreants tried to flee away, when they were chased, they managed to flee and the informant fell injuring himself. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name has come on the confessional statement of co-accused and nothing has been recovered.
The learned A.P.P. for the State opposes the bail application and submits that petitioner has six antecedents. Considering the fact that the petitioner is in custody since 10.12.2020 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Pipra P. S. Case No.217 of 2018, with a condition that till the charges are not framed, the petitioner will have to mark his attendance before the concerned police station on 15th of every

No.34379 of 2021(2) dt.01-12-2021 3/3 month commencing from December, 2021 and in the event, it is reported to the learned Court below that petitioner failed to comply with the direction of the Court, the learned Court below shall be at liberty to cancel his bail bonds.
