This application, for grant of anticipatory bail, arises out of Dhamdaha Police Station Case No. 88 of 2015, disclosing offences under Sections 406, 420, 467, 468, 471, 120B of the Indian Penal Code.
The allegation is of execution of a sale deed in the year 1984 by one Sharda Nand Thakur in favour of the complainant, with respect to land mentioning incorrect khata number, khesra number and boundaries.
Learned Counsel for the petitioner has submitted that said Sharda Nand Thakur has been granted regular bail by this Court. He has, further, submitted that
Patna High Court Cr.Misc. No.25094 of 2017 (4) dt.07-07-2017 2/2 the petitioner has been made accused for the sole reason that he is the witness to the execution of the said sale deed.
Considering the above submission, this application is allowed.
Let the petitioner, Sunil Kumar Jha, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Dhamdaha Police Station Case No. 88 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
