Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Raghopur P.S. Case No. 382 of 2022 registered for the offence under Sections 457/380 of the Indian Penal Code. As per the prosecution story, on 04.10.2022, while the informant was sleeping in his rented room some unknown culprits committed theft in the house of the informant and stolen away various articles including HP Laptop, cloths, wrist watch, etc.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.01.2023 and the petitioner is not

Patna High Court CR. MISC. No.24292 of 2023(2) dt.19-05-2023 2/2 named in the F.I.R. and his name has come only on the confessional statement of the co-accused namely Dharmendra Kumar.

Learned counsel for the petitioner further submits that on the confession, the petitioner was arrested and police recovered the stolen articles of the petitioner and in his statement, he stated that the stolen laptop has been purchased by him.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, Supaul in connection with Raghopur P.S. Case No. 382 of 2022.
