The petitioner apprehends his arrest in a case under Sections 406, 409, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

The petitioner is the Chairman of Satlakha PACS. The auditor pointed out that the petitioner forwarded the names of three persons for grant of KCC loans although those persons were no more alive and the loans were disbursed in the sum of Rs. 20,000/-, Rs. 20,000/- and Rs. 40,000/- to three different persons. It is submitted that the petitioner, of course, recommended for grant of loans but he had no knowledge about the death of those persons and the moment the petitioner came to know about the illegality, the entire amount of Rs. 80,000/- was deposited in the account and no loss is caused to the Bank.

Patna High Court Cr.Misc. No.51726 of 2015 (2) dt.18-12-2015 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Madhubani P.S. Case No. 229 of 2015 / G.R. No. 1559 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
