The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code.

Earlier bail application of the petitioner was rejected vide order dated 03.12.2020 passed in Cr. Misc. No.31787/2020. Vide order dated 01.09.2021, a report was called for from the Court of learned Additional District and Sessions Judge-XI, Saran at Chapra, which is kept at Flag 'X' in which it is stated that this case stands committed to the court of learned Sessions Judge on 10.08.2021 and thereafter, received to this court on 11.08.2021. It is further stated that the charge is yet to be framed and next date is 11.09.2021 fixed for framing of the

Patna High Court CR. MISC. No.35632 of 2021(3) dt.02-11-2021 2/2 charge.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Mashrak P.S. Case No. 144/2016 to the satisfaction of learned Court below where the case is pending/ successor Court.
