JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.03.2022, charge-sheet has been submitted in the case and is a person with clean antecedent. Allegation is of total recovery of 549 litres of liquor from two vehicles as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner is the driver of the Alto car and as such was not knowing who had kept the liquor in the car when it was parked.

Patna High Court CR. MISC. No.24675 of 2022(2) dt.20-05-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 25.03.2022, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Aurangabad Town P.S. Case No. 165 of 2022.
