JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 05-11-2015 In view of the notification annexed as Annexure-A to the counter affidavit, filed on behalf of the Principal Secretary, Department of Co-operative, dated 3.11.2015, the relief prayed on behalf of the petitioners has already been granted. If there is any discrepancy in identification of need- based posts etc. the same can be raised before the authority.

Now that the posts have been identified, steps for grant of promotion will now be taken. The notification of the General Administration Department has lost its meaning now in view of the fact that learned Single Judge of this Court as well as the Division Bench has already struck down the circular relating to grant of promotion to SC/ST candidates in matters of promotion. Till date there is no order passed by the Apex Court in this regard, therefore, there is no impediment in consideration of grant of promotion.
