JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Garkha P.S. Case No.187 of 2015 registered under sections 366A and 379/34 of the Indian Penal Code.

It is contended that the alleged victim Nikki Kumari, who is a married lady aged about 22 years, in her statement made under section 164 of the Code of Criminal Procedure has categorically stated that out of her own sweet will she left her matrimonial home and married co-accused Shahrukh Alam. Learned counsel for the State has opposed the prayer for

Patna High Court Cr.Misc. No.49346 of 2015 (2) dt.03-11-2015 2/2 grant of anticipatory bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri M.K.Rai, Judicial Magistrate, 1st Class, Chapra in connection with Garkha P.S. Case No.187 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
