JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Mahila P.S. Case No. 33 of 2018, disclosing offences under Sections 341, 323, 379, 498A, 504, 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Case is under Section 498-A of the IPC.

Submission of learned counsel for the petitioner is that he is still ready to keep her with dignity and care. In this case, on appearance of the opposite party no. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 19.04.2019, but the mediation failed.

Patna High Court CR. MISC. No.24015 of 2019(3) dt.19-07-2019 2/2 party no.2 is that she is still ready to reside with the petitioner, if she is allowed to live with full dignity and care. In such a circumstances, let the petitioner surrender before the learned court below on 31.07.2019, on that day, the opposite party no.2 shall also remain present in the Court. Further on filing of an affidavit by the petitioner that he is still ready to keep her with dignity and care, where he reside, he shall be enlarged on provisional bail for a period of six months During that period, the learned court below shall watch the conduct of both the parties, especially the conduct of the petitioner and they will appear before the learned court below on second week of every month. Once the court below is satisfied with the conduct of both the parties, either shall confirm the bail of the petitioner or he is free to pass any order as it deem fit and proper, including the cancellation of bail bonds of the petitioner.

With the aforesaid observations, this application is disposed of.
