====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Triveniganj P.S. Case No. 324 of 2018, instituted for the offence under Section(s) 341, 323, 324, 326, 307, 504 and 506/34 of Indian Penal Code. It is alleged in the written report that on the date of occurrence at about 1:00 a.m. in the night while father of the informant was sleeping in his house, petitioner along with coaccused Sanjay Marik came and took away father of the informant with them. It is further alleged that both accused persons took out left eye of father of the Informant Upendra Marik and left him in unconscious state.

The statement of father of the informant has been

Patna High Court CR. MISC. No.21826 of 2019(4) dt.30-05-2019 2/2 recorded in paragraph-38 of the case diary wherein he has alleged that he was taken away by six persons including petitioner.

The injury report of father of the informant is available in paragraph-32 of the case diary wherein the Doctor has found one injury on the left eye ball caused by hard and blunt substance.

Petitioner is in custody since 28.8.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Supaul, in connection with Triveniganj P.S. Case No. 324 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
