The petitioner apprehends his arrest in Sarmera P.S. Case No. 43/2016, registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code. The informant alleged that his daughter was married to Jairam Yadav son of the petitioner three years ago, but the accused persons killed his daughter and cremated her dead body. It is submitted that the petitioner is father-in-law of the deceased. He never tortured the deceased. He is an old man aged about eighty five years. No specific allegation of torture is made against him. Nor any complaint of demand of dowry and torture was made during three years after marriage and before the death of

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is father-in-law of the deceased, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 43/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
