The petitioner apprehends his arrest in Kurhani P.S. case No.280 of 2015 under Section 353, 448 and other Sections of the Indian Penal Code and under Section 3⁄4 of Damage to Public Property Act.
A truck knocked down three woman Kanwariyas. On such, many villagers assembled on road and raised slogans. It is submitted that petitioner was not known to the informant and he has falsely been implicated in the case at the instance of his enemies. No specific allegation is made against the petitioner. Many villagers assembled and raised slogans against rash and negligent driving of the vehicles on the road. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named
Patna High Court Cr.Misc. No.48857 of 2016 (2) dt.16-12-2016 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, learned Judicial Magistrate, 1st class, Muzaffarpur in Kurhani P.S. Case No. 280 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
