Since the physical court proceeding is non-functional, due to present pandemic COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Accusation against the petitioner is of torture for non-

Patna High Court CR. MISC. No.26419 of 2020(2) dt.12-10-2020 2/2 fulfillment of demand of dowry and due to non-fulfilling of the same, she killed the daughter of the informant and disposed of the dead body.

It has been submitted on behalf of the petitioner that she is innocent and has been falsely implicated in this case. He submits that there is no specific allegation against the petitioner and she is in-laws. He submits that husband of the deceased is already in judicial custody. He further submits that petitioner has no criminal antecedent and she is languishing in judicial custody since 28.12.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Kasba Police Station Case No. 152 of 2019.
