JUSTICE RAVI RANJAN ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 407, 324, 447, 435, 379, 384, 504/34 of the Indian Penal Code.

It is contended that there is a case and counter case between the parties. There is general and omnibus allegation against the petitioner. He is only a member of unlawful assembly. There is land dispute also. It is stated that the petitioner's antecedent is clean.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Bambam Yadav be released on bail in the event of his arrest/surrender before the court below

Patna High Court Cr.Misc. No.34294 of 2016 (2) dt.15-09-2016 2/2 within a period of six weeks from today in connection with Basnahi P.S. Case No.95/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa subject to the conditions as laid down under sub-section

(2) of Section 438 of the Code of Criminal Procedure. However, at the time of accepting bail bond, the court below would verify and assure itself regarding the criminal antecedent of the petitioner. If he is having clean antecedent then his bail bond would be accepted. If he is found to be involved in any other case before 4.08.2016 then he would be taken into custody.
