JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-03-2015 This is an application under Section 482 of the Code of Criminal Procedure seeking quashing of the First Information Report of Mithanpura P. S. Case No. 111 of 2006 for the offences punishable under Sections 341,323,379/34 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the First Information Report needs to be quashed as till date there has not been any progress in investigation. He further submits that the petitioner has neither been named in the First Information Report nor his name has transpired in course of investigation. The submission as advanced on behalf of the petitioner for the purpose of quashing of the First Information Report is wholly misconceived. Such cannot be a ground for quashing of an FIR.

Patna High Court Cr.Misc. No.49560 of 2012 (2) dt.13-03-2015 As a matter of fact, I do not find any cause of action for the petitioner to have approached this Court under Section 482 of the Cr.P.C for quashing of the FIR as according to his own submission, he was neither named in the First Information Report nor his name cropped up in course of investigation. I do not find any merit in this application. This application is accordingly, dismissed.
