The petitioner seeks bail in Special Case No. 9384/2018, arising out of Rail Danapur P.S. Case No. 94/2018, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that when the informant was going to take command on platform no. 1 of Danapur Railway Station he saw two persons coming down with several bags. The informant seized 8 bags from which 500 pieces, each containing 180 ml, of foreign liquor were recovered.
Learned counsel for the petitioner has submitted that it is mentioned in the seizure-list that seizure has been made
Patna High Court Cr.Misc. No.80809 of 2018(2) dt.16-01-2019 2/2 from Rail P.S. Danapur. There is no mention that aforesaid liquor has been recovered from conscious possession of this petitioner.
Petitioner is in custody since 06.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court, Excise, Patna, in connection with Special Case No. 9384/2018, arising out of Rail Danapur P.S. Case No. 94/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
