The petitioner apprehends his arrest in Bathanaha P.S. Case No.308 of 2018 registered under Sections 272, 273 and 34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant alleged that on secret inputs about keeping liquor in the house of Manti Devi and on such, the house of Manti Devi was raided and 380 litres of liquor of different brands were recovered. Manti Devi disclosed that the petitioner and others had kept the liquor in her house. Learned counsel for the petitioner submits that there is no evidence to show that the petitioner and others had kept liquor in the house of Manti Devi. Manti Devi in order to save her skin, disclosed the names of petitioner and others.

No.23845 of 2019(2) dt.12-04-2019 2/2 Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II-cum-Special Judge (Excise Act), Sitamarhi in connection with Bathanaha P.S. Case No.308 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
