Petitioner apprehends his arrest in Barbigha P.S. Case No.42 of 2019, registered under Sections 420 and 120(B) of the Indian Penal Code.

The informant, Center Superintendent of S.K.R. College, Barbigha, alleged that Pankaj Kumar, Block Teacher, Madhya Vidyalaya, Aijehi, Murarpur, informed him that while he was going to submit the answer sheets of the examinees, Rahul Kumar and 2-3 other students came and snatched one answer sheet bearing Roll Code 86001, Roll No.19010650. The informant further alleged that he suspects the hand of Pankaj Kumar, Block Teacher in the office.

Learned counsel for the petitioner submits that it was

No.25828 of 2019(2) dt.22-04-2019 2/2 petitioner who was going to submit the answer sheet and when Rahul Kumar and others came and snatched the copy, the petitioner informed the Center Superintendent. The Center Superintendent without rhyme and reason implicated the petitioner on the mere assumption that petitioner also might have connived with the students.

Taking into consideration the nature of allegation made against the petitioner and the fact that it was petitioner who informed the Center Superintendent, the informant, about snatching of the answer sheet by Rahul Kumar and others but petitioner has also been made accused, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheikhpura in connection with Barbigha P.S. Case No.42 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
