All the petitioners before this Court are family members of the co-accused Pankaj Kumar Paswan who allegedly abducted the daughter of the informant with intention to marry her. The occurrence of abduction took place on 26.01.2017 whereas the FIR was lodged on 01.02.2017. The victim was produced before Magistrate where her statement was recorded under Section 164 of the Cr.P.C. She disclosed her age as 20 years and the Magistrate has assessed her age as 16 years. As per assertion made in para-12 of this application, the victim was produced before the medical board where her age was assessed in between 17-18 years. The victim has denied the allegation of
Patna High Court Cr.Misc. No.30922 of 2017 (2) dt.06-07-2017 2/2 abduction. She has stated that she voluntarily left the house and married with Pankaj Kumar Paswan with whom she is residing as husband and wife. She is not stated anything against these petitioners.
In view of the aforesaid facts, let the above named four petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Birpur P.S.Case No.08 of 2017 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-Ist, Begusarai, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
