ANJANA MISHRA ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in connection with the present case though the informant has stated that he was robbed by three unknown persons, subsequently, the name of the present petitioner has been brought in. He submits that the petitioner has been falsely implicated in this case only because there was business transaction between the two with regard to wine shop entered by them. He further submits that had the petitioner participated in the same, the two parties being well known to each other, the petitioner could have been well named as one of the three persons

Patna High Court Cr.Misc. No.31496 of 2017 (2) dt.20-07-2017 P2/2 who had participated in the occurrence.

Considering the aforementioned facts and circumstances of the case, let the petitioner above named, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sitamarhi, in connection with Bairgania P.S. Case No. 04/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
