The learned counsel for the petitioner submits that the notice has been received by the family members of the sole opposite party and the sole opposite party is living jointly. In these circumstances, the service of notice is accepted as valid.

The petitioner is the wife of the opposite party, namely, Vivek Kumar Jaisawal, who has filed this application for transfer of Matrimonial Case No. 225 of 2021 from the Principal Judge, Family Court, Motihari, East Champaran to any competent Court at Sitamarhi.

The petitioner is a young lady dependent upon her old and ailing parents. It is causing much inconvenience to her to travel to Motihari to Sitamarhi to contest the matrimonial case along with her girl child.

Patna High Court MJC No. 721 of 2022(3) dt.12-10-2022 2/2 Considering the facts of the case, the Matrimonial Case No. 225 of 2021 is directed to be transferred from the Principal Judge, Family Court, Motihari to Principal Judge, Family Court, Sitamarhi .

After transfer of the case in the Court of Principal Judge, Family Court, Sitamarhi, the Principal Judge, Sitamarhi, will issue notice to both the parties and, thereafter, the proceeding will continue in the Court of Principal Judge, Family Court, Sitamarhi.

With the aforesaid observation and direction, this application is allowed.
