JUSTICE SANJAY PRIYA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Salimpur P.S. Case No. 126 of 2016 instituted for the offence under Sections 406, 409, 420 and 34 of the Indian Penal Code. As per allegation in the written report, this petitioner in the capacity of Secretary of the school along with the Headmaster, has withdrawn Rs.7,90,200/- in the year 2006-07 for construction of the school building but the construction work of the school building was not carried out and this petitioner who was the Secretary along with the Headmaster of the school, Janardan Paswan (since retired) has misappropriated the aforesaid amount.
In this manner, there is specific allegation against the
Patna High Court Cr.Misc. No.29910 of 2017 (2) dt.12-07-2017 2/2 petitioner of misappropriating the government money which was allotted for construction of the school building in the year 200607. In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail (Sanjay Priya, J) S.Ali/- U T
