JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
It is alleged against the petitioner that petitioner settled the land of Aakashi Math to some persons for Rs. 1,54,600/-.
It is submitted by learned counsel for the petitioner that it is not disclosed in the First Information Report that land has been settled in whose favour. Moreover the accusation has been levelled in the background of dispute with regard to the claim in the management of the concerned Math. It is further submitted that petitioner never settled the land of the Math. It is also submitted that petitioner has filed writ application being C.W.J.C. No. 1775 of 2015 with regard to the
Patna High Court Cr.Misc. No.41161 of 2015 (2) dt.07-10-2015 2/2 constitution of the management of the Math.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. It is submitted by learned counsel for the informant that when the petitioner lost his claim for being in the management of the Math up to the LPA level, then he settled the land of the Math. However, learned counsel for the informant failed to explain as in whose favour the settlement has been made.
Considering the accusation levelled in the background of dispute with regard to the management of the Math and the petitioner having no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram(Agrer) P.S. Case No. 606 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
