The petitioners apprehend their arrest in connection with Complaint Case no. 109 of 2010 for the offences alleged under Sections 153A, 295, 323, 341, 504, 506 and 380 of the Indian Penal Code.
The complaint has been filed against the petitioners, who are Bank officials and it is alleged that these petitioners along with other Bank officials came to the shop of the
Patna High Court Cr.Misc. No.51612 of 2015 (2) dt.10-12-2015 2/2 informant and forcibly took several articles. It is submitted by the learned counsel for the petitioners that the occurrence took place on 13/14.01.2010 at 8.00 A.M. but the complaint case has been filed on 22.01.2010 and no reason has been assigned for the delay in filing the complaint case. Further, it has been submitted by the learned counsel for the petitioners that one Narendra Ram an employee of Bank of Baroda have filed Sasaram(P) P.S.Case No. 45 of 2015 against the complainant and the present case is a counter case to the earlier case.
Be that as it may, let the above named petitioners, in the event of their arrest/ surrender before the Court below within a period of six week from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand0 each with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas, Sasaram in Complaint Case No. 109 of 2010, subject to the conditions as laid down u/s 438(2) Cr.P.C.
