JUSTICE RAVI RANJAN ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420 and 120(B) of the Indian Penal Code and Section 3(i)(x) of SC and ST (Prevention of Atrocities) Act.

It is contended on behalf of the petitioner that a sale deed was executed for the land in question in favour of another person and the money was grabbed. The only allegation against the petitioner is that, on the assurance of the petitioner, the money was given to the co-accused Md. Raji Alam. It is a case of civil nature. It is contended that so far as petitioner is concerned, there

No.31412 of 2016 (2) dt.16-08-2016 2/2 is no specific allegation of taking money etc. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in connection with trial No.4399 of 2015 arising out from Complaint case No.C-1136 of 2014 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Smt. Rashmi, Judicial Magistrate, Muzaffarpur, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
