JUSTICE RAVI RANJAN ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 326, 307, 504/34 of the Indian Penal Code.

It is contended that altercation was due to dispute with regard to measurement of the land between the parties. As per allegation, the petitioner had assaulted upon the forehead of the informant with 'pasuli', a sharp cutting weapon and also on the left index finger, however, it is contended that the injury on the forehead was found simple in nature caused by hard blunt substance and only lacerated wound on left index finger was found. Thus, it is urged that the assault by sharp cutting weapon was not supported by the injury report. It is stated that the

Having regard to the facts and circumstances of the case, let the petitioner, namely, Ramishwar Ram be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Maharajganj P.S. Case No.89 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Siwan subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
