JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-08-2020 At the very outset, learned counsel appearing on behalf of the petitioner submits that in e-filing of the bail petition, page no.7 was not uploaded which contains prayer portion. He submits that the same has been supplemented.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Salimpur P.S. Case No. 48 of 2020, Excise Case No. 1896 of 2020 for offences under Sections 147, 148, 149, 323, 504, 353, 427, 224 and 225 under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedents. It is alleged that the petitioner was involved in selling liquor and the name of the petitioner was disclosed by Chowkidar of

Learned counsel appearing on behalf of the petitioner would submit that noticing the fact that the petitioner has been falsely implicated the villagers protested and as such more than 100 persons have been made accused in the instant case. Considering the fact that the petitioner has no criminal antecedent and alleged recovery of liquor was made from Goshala which is situated at a distance of 70 feet from his house, the Court is inclined to grant bail to him subject to the condition that the petitioner has to deposit Rs.50,000/- in cash. On depositing the amount of Rs.50,000/-, petitioner, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs.

50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Salimpur P.S. Case No. 48 of 2020, Excise Case No. 1896 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of the instant criminal case.
