JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Sections 494, 420, 406/34 of the Indian Penal Code.
Prosecution case is that the informant had finalized the marriage of his sister with the petitioner and during negotiation bride-groom has assured that petitioner is unmarried. Thereafter, date of marriage was fixed on 14.12.2020. On 13.12.2020, the sister of the informant received
Patna High Court CR. MISC. No.32694 of 2021(2) dt.09-07-2021 2/3 massage and certificate along with details of earlier marriage of petitioner with Anita Kumari. Thereafter, the informant inquired the matter and got knowledge that Ravi Shankar Kumar (petitioner) has already been married and he was living in a rented house.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that Anita Kumari is wife of Sri Madhav Bihari Singh and petitioner has no relationship with Anita Kumari. He submits that informant has committed mar-pit with the petitioner and also snatched the motorcycle including Rs. 50,000/- cash for which brother of the petitioner has also filed complaint case before the civil court. He submits that informant has finalized the marriage of his sister with the petitioner against the will of his sister. He submits that sister of the informant has love affairs with one Pintu Sah and on 14.12.2020 the marriage of sister of informant has also been performed with Pintu Sah. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 17.12.2020.
In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.32694 of 2021(2) dt.09-07-2021 3/3 bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below/successor court where the case is pending in connection with Ahiyapur P.S. Case No. 951 of 2020.
