The petitioner apprehends his arrest in Ganga Bridge P.S. case No. 37 of 2014 under Section 379, 353, 323 and other Sections of the Indian Penal Code.
The informant, Enforcement Sub Inspector, alleged that while he along with other officials were checking the vehicles for collecting tax, the petitioner and others came, ransacked the office and set ablaze different vehicle. The informant and other officials somehow saved their life.
The learned counsel for the petitioner submits that petitioner is owner of vehicle bearing registration No. JH 02 N2217. No specific allegation is made against the petitioner.

The petitioner is one of them, who formed unlawful assembly, ransacked the check post and set ablaze many vehicles standing there.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, i.e., the learned Chief Judicial Magistrate, Vaishali at Hajipur in Ganga Bridge P.S. case No. 37 of 2014, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit and dispose of the bail petition, preferably, on the same day, without being prejudiced from the order of this court.
