JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 12-01-2015 Heard learned counsel for the parties.

The petitioner is aggrieved by order dated 04.09.2012, passed by the Sub-Divisional Magistrate, Aurangabad in Case No. 1294 of 2012. The learned Magistrate in the impugned order observed that as long as a Title Suit is pending, the 1st party will have a right of passage.

Learned counsel for the petitioner assailing the said order submits that the first party nowhere has stated that no other way of access option.

In my view, all these matters can be considered in the suit itself. In case, if any such petition is filed, the same would be considered on its own merit without being prejudiced by this order.

Patna High Court CR. REV. No.1068 of 2012 (9) dt.12-01-2015 2 / 2 Any order passed by the learned Magistrate will be subject to the order passed in the title suit. This application stands disposed of.
