The petitioners apprehend their arrest in Dandari P.S. Case No. 57 of 2016 registered for the offences punishable under Sections 363, 366a and 34 of the Indian Penal Code. The informant alleged that her daughter who is a student of Class-X went to market for some urgent work but she did not return. During course of search the informant came to know that Asfaq Alam kidnapped her daughter and the petitioners who are brothers of Asfaq Alam helped him.
Learned counsel for the petitioners submits that there is no eye witness of the occurrence. Nobody has seen the petitioners in the company of Asfaq Alam. The allegation of kidnapping is against Asfaq Alam. The petitioners are brothers of Asfaq Alam
Patna High Court Cr.Misc. No.15556 of 2017 (3) dt.30-06-2017 2/2 and that is why they have been implicated in the case. Learned APP did not dispute this fact.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Begusarai in Dandari P.S. Case No. 57 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
