JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-12-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. Petitioner seeks regular bail in connection with Town P.S. Case No. 689 of 2020 registered for the offence under Section 392 of the I.P.C., Section 27 of the Arms Act and later on Sections 395 & 412 of the I.P.C. was added. The prosecution story is that the informant was intercepted by three miscreants riding on a motorcycle and on gun point they looted a sum of Rs. 1 Lakh from the informant. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name has transpired on the basis of confessional statement made by arrested coaccused / Chhotu Kumar.

He next submits that except confessional statement, no material has come against the petitioner during the course of investigation.

Patna High Court CR. MISC. No.32650 of 2021(2) dt.17-12-2021 2/2 from other co-accused persons, petitioner has got no criminal antecedent and he is in custody since 27.01.2021. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, no looted money has been recovered from the possession of the petitioner, petitioner is in custody since 27/01/2021, no T.I.P. has been conducted by the Police and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- ( twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur, District Vaishali in connection with Hajipur Town P.S. Case No. 689 of 2020.
