The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 302, 504, 506, 120(B) of the Indian Penal Code.

It is a case of commission of murder of the husband of the informant in the background of some land dispute by all the F.I.R named accused persons including the petitioner.

Patna High Court CR. MISC. No.30278 of 2024(2) dt.02-05-2024 2/3 been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner has sold his own land which was in his share and he has not committed any forgery or conspiracy against the informant. There is no specific allegation against the petitioner and in the background of some land dispute, the present accusation has been levelled against the petitioner. The husband of the informant was aged about 74 years and was very old and the postmortem report suggests that cause of death was natural. Moreover, other similarly situated co-accused have been granted bail vide order dated 07.08.2023 passed in Cr. Misc. No. 19031 of 2023. The petitioner is languishing in custody since 07.12.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period

No.30278 of 2024(2) dt.02-05-2024 3/3 under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Patori P.S. Case No. 594 of 2022.
