JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 05-02-2019 The appellant seek pre arrest bail in connection with Biraul P.S. Case No. 181 of 2018, registered for offences punishable under Sections 147, 341, 323, 307 of the Indian Penal Code and Section 3(1) (r) of SC/ST Act.
Allegation against the appellant is of abusing the informant by caste name and also of assaulting him on his head. It has been submitted on behalf of the appellant that he has falsely been implicated in this case in the background of land dispute between the parties and injury report of the informant appears to be manufactured one.
Learned Special P.P. as well as learned counsel for the informant opposed the payer of the appellant and submitted that the injury caused to the informant was found to be simple in
Patna High Court CR. APP (SJ) No.4834 of 2018 dt.05-02-2019 2/2 nature.
Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of pre arrest bail to the appellant, however, appellant so desire may surrender before the court below and pray for regular bail, which will be considered by the court below on the merit of the case, witout being prejudiced by the order of this Court.
Accordingly, this appeal is dismissed.
