JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-05-2023 The present writ petition has been filed seeking the following reliefs:- "1(A). That this application is being filed for issuance of a writ in the nature of mandamus Commanding and directing the respondents authority to remove the encroachment over the Government land bearing Khata No-136, Plot No-2469 total area measuring about 2 Decimal, of village-Rajputan Muhalla, Goah, P.O.+P.S.- Goah, District Aurangabad, the nature of the said land is recorded in C.S. Khatian as "Gairmazarua

Patna High Court CWJC No.6063 of 2023(2) dt.05-05-2023 2/2 Aam Land" and the said land is being used by public in general, as 'Rasta'.

(B). Further directing the respondents, to remove the said encroachment by way of complying the various order passed by the competent authorities in different dates as they found encroachment over the land by the private respondent no-9 of this writ petition. And also comply the order dated 28.11.2007, passed by Hon'ble High Court in C.W.J.C. No- 14089/2007, with regard to the redressal of the grievance of the petitioner." After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
