JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Makhdumpur P.S. Case No. 401 of 2018 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act and Sections 420, 467, 471 and 120B of the Indian Penal Code.

Allegation is of recovery of 310 litres of liquor from a Tavera vehicle and two persons were arrested, who disclosed that petitioner managed to escape.

Submission of learned counsel for the petitioner is that he is neither driver nor owner of the vehicle and there is no recovery from his possession and he has no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court Cr.Misc. No.80514 of 2018(3) dt.14-02-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II, Jehanabad, in connection with Makhdumpur P.S. Case No. 401 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
