The petitioner seeks bail in connection with Kurtha P.S. Case No. 153 of 2018 instituted for the offence under Section(s) 461/379/411/34 of the Indian Penal Code. Learned counsel for petitioner submits that petitioner is in custody since 24.8.2018 having no criminal antecedent. Learned counsel further submits that petitioner has been implicated in this case merely on suspicion.
The informant has alleged that several articles has been stolen from his gumti as mentioned in the written report. It is further alleged that informant learnt that one unknown person has been apprehended by the villagers near the brick kiln of Suryadeo Yadav and stolen articles have been recovered from
Patna High Court Cr.Misc. No.79815 of 2018(2) dt.16-01-2019 2/2 his possession and he disclosed his name Vikash Kumar Ravidas (petitioner). It is further alleged that petitioner also disclosed the name of other associate who managed to run away as Mantu Kushwaha Seizure list is part of the FIR.
Learned counsel for petitioner submits that there is no recovery of any stolen articles from conscious possession of this petitioner. It is mentioned in the seizure list that recovery of stolen articles has been made near the brick kiln of Suryadeo Yadav Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 153 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
