JUSTICE ARUN KUMAR ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.
Allegation in brief is that her husband and others and this petitioner assaulted the mother of the informant and committed theft.
Submission is that there is no specific allegation against the petitioner and police after investigation not finding her involvement not sent up for trial and final form was submitted but now the cognizance has been taken on the same material. Moreover, there is no injury sustained by so-called Marachhi Devi.
Patna High Court Cr.Misc. No.30053 of 2017 (2) dt.10-07-2017 2/2 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Kunti Devi be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IIIrd, Nalanda at Bihar Sharif in connection with Harnaut (Chero) P.S. Case No.134 of 2003, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
