NILU AGRAWAL ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner, learned counsel for the complainant and learned A.P.P. for the State. Vide order dated 04.03.2016, the matter was referred to the Mediation Centre, Patna High Court, Patna for settlement of the dispute between the parties. The matter was taken up by the Patna High Court Mediation Centre in Mediation Proceeding No. 85 of 2016 and one time settlement was reached between the parties whereby the petitioner agreed to pay a sum of Rs.50, 000/- to the Opposite Party No. 2, Nilam Devi as full and final settlement by 06.07.2016.

However, learned counsel for the petitioner submits

Patna High Court Cr.Misc. No.7678 of 2014 (9) dt.13-06-2016 2/2 that the demand draft of Rs. 50,000/- could only be prepared on 12.07.2016 vide Demand Draft No.03571, drawn by State Bank of India, Bhabhua Branch, which has been handed over to the learned counsel for the complainant. The complainant, Nilam Devi is also present in person. Let the demand draft of Rs. 50,000/- be handed over to the complainant Nilam Devi, who is present in person. A photocopy of the said Demand Draft may be kept on record.

In view of the settlement reached between the parties, the Complaint case No. 713/2011, pending before the learned S.D.J.M., Sasaram, Rohtas as per the terms of the settlement will not be pursued further and will be consigned. Let a copy of the order dated 04.03.2016 passed in Cr. Misc. No. 7678/2014 along with the settlement of the Mediation Centre, Patna High Court dated 11.05.2016 in Mediation Proceeding No. 85/2016 alongwith the photocopy of the Demand Draft be sent to the Court of learned S.D.J.M., Rohtas at Sasaram for needful action in this regard.
