Ashraf has been arrested, hence, his application has become infructuous and accordingly, it is disposed of. The petitioner nos. 1, 3 and 4 are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427 and 504 of the Indian Penal Code.

The prosecution case is that the accused persons including the petitioners were fighting with someone in the cinema hall of the informant when the informant forbade them hey assaulted the informant.

No.41214 of 2015 (2) dt.07-10-2015 2/2 It is submitted by learned counsel for the petitioners that the injuries of the informant have been found only bruise and abrasion, superficial simple in nature. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners except petitioner no. 2 be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Samastipur Town P.S. Case No. 220 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
